Why is this time on Xanga's low state of functioning counting towards ones subscription time?

People who had premium for a few months after the exchange are losing their privileges because their account time expired.

Shouldn't the subscription clock be frozen until Xanga is in a reasonable good working state with an operating front page for the users?
